Man accused of assaulting officers waives hearing

From staff reports

A Franklin man facing charges for assaulting three police officers at an apartment in Franklin waived his preliminary hearing Wednesday in Venango County Central Court.

Mitchell Rudolph, 30, will now face further court proceedings on three felony counts of assault of a law enforcement officer, three misdemeanor counts of terroristic threats, single misdemeanor counts of resisting arrest, defiant trespass and criminal mischief, and three misdemeanor counts of disorderly conduct.

A criminal complaint filed by Franklin police said police responded to an apartment building at 10 Taylor St. on June 12 where they heard Rudolph shouting inside one of the apartments.

Rudolph, who “showed outward signs of alcohol intoxication”, had punched six large holes in the drywall of the apartment and had refused to leave the apartment when told to by a resident, the complaint said.

Rudolph resisted officers’ verbal commands and continued to resist when he was placed under arrest, the complaint said.

When an officer tried to handcuff Rudolph, he pulled away and began punching and kicking officers, according to the complaint.

When officers successfully handcuffed him and began taking him to a stairwell in the building, Rudolph tried to wedge himself in the doorway of the stairwell and then tried to lunge down the stairs, pulling the officers with him, the complaint said.

Rudolph was loudly screaming obscenities at the officers and threatening to kill them during the altercation, according to the complaint.

Rudolph continued to resist the officers as he entered the back of the police car, and once he was inside he continued to threaten to kill the officer driving the car, the complaint said.
