A father and son from Kennerdell who are facing felony burglary charges in connection with an altercation in Frenchcreek Township in March waived their preliminary hearings Wednesday in Venango County Central Court.
Charges filed against 22-year-old Marvin Fisher and his father, 52-year-old Martin Fisher, will now be bound over for further proceedings in the Court of Common Pleas.
Charges filed in the same came against Joseph Fisher, 26, were withdrawn Wednesday.
A criminal complaint filed through district judge Matthew Kirtland’s office said Marvin Fisher and Martin Fisher were both interviewed by state police in Franklin about the events of March 26.
A fight had taken place that day at a home on Georgetown Road involving Joseph Fisher, and the father-son tandem was believed to be in a vehicle that returned to the home after the scuffle, the complaint said.
Police found three broken windows, blood on the rear door of the home, dirt marks from a shoe on the rear door, blood on the bedroom exterior window frame and damage to a vehicle, the complaint said.
The homeowner fired a warning shot into the ground, and the Fishers then left in a truck heading toward Franklin, the complaint said.
Marvin Fisher told police on March 28 that he and his father broke the windows, and that Joseph Fisher did not go with them, the complaint said.
Later in the interview, the complaint said Martin Fisher told police he never heard a gunshot and he was unaware of a car being damaged, the complaint said.
Martin Fisher also apologized to police during the interview for previously lying because he was looking out for his kids, the complaint said.
Both Marvin and Martin Fisher have been charged with a first-degree felony count of burglary, a second-degree felony count of criminal trespass, a misdemeanor count of terroristic threats, a misdemeanor count of recklessly endangering another person, a misdemeanor count of simple assault, two misdemeanor counts of criminal mischief, a misdemeanor count of defiant trespass and one count of harassment.
The charges against Joseph Fisher that were dismissed included burglary, criminal trespass, simple assault, recklessly endangering another person and criminal mischief.
Marvin and Martin Fisher remain free on $50,000 unsecured bail each.
